1.    General terms and conditions

These terms and conditions govern reservations and stay at Parc les Vallons (SA Heindrichs-Schauss), as well as the terms of payment for services. By signing the offer, the hirer acknowledges the validity and application of these terms and conditions without reservation or exception.

2.    Arrival & departure

Unless otherwise agreed in writing, accommodation must be checked in from 3.00 pm on the day of arrival. On the day of departure, they must be vacated by 10:00 am. In the event of late check-in, a minimum charge of €40.00 per accommodation will be applied. (Maximum one additional night). 

3.    Reservations & Options, cancellation    

Reservations made by the customer must be confirmed by letter or electronic mail (e-mail) and guaranteed by payment of the deposit (above).   In the event of cancellation, only a written letter or e-mail will be considered valid. 

Unless otherwise agreed in writing by the rental company (SA Heindrichs-Schauss / Les Vallons) Partial or total cancellation of a booking will give rise to compensation based on the rental offer here made (total), and calculated as follows:

• 70 to 31 days prior arrival date: 20% of the rental price.
• 30 to 8 days prior arrival: 50% of the rental price.
• 7 to 2 days prior arrival: 75% of the rental price.
• Less than 48 hours before arrival date: 100% of the rental amount.

Additional charges (such as invoices from external service providers, subject to other conditions) or administrative fees may apply.

Cancellation fees may be deducted from the reservation deposit.

In the event of cancellation within the above deadlines, the deposit will be returned to the tenant by bank transfer, less a flat-rate charge of €20.00 (transaction and administrative costs). Additional charges (to be justified by Heindrichs-Schauss AG) may be applied in addition to the due sum.  An offer or option are free of charge cancellation (no charge in the event of cancellation).

Placed offers and options are valid for 10 days (date of demand) An option is valid and placed only by written request 

4.    Rules and Regulations Les Vallons Sa Heindrichs-Schauss

All guests must show proof of identity on arrival. Guests must also behave in accordance to the customs and rules of the establishment where they are staying. Any serious or repeated violation of the rules of our establishment or of Belgian law.  We (Sa Heindrichs Schauss) reserve the right to terminate the contract without notice. The customer is liable to Les Vallons (for any damage caused to persons to the buildings, furniture or equipment of the establishment. Les Vallons Rental House or/and Reception Hall) and the premises accessible to the public on the Site B-4960 Malmedy Route d'Eupen 54.  The tenant is obliged to use the premises entrusted to him with due care and to return them to Les Vallons (Sa Heindrichs-Schauss) in perfect condition at the end of the rental contract. At the latest at the end of the rental period, the tenant must restore the premises to their pre-rental condition, at the tenant's expense. The tenant may use his/her own bed linen, or rent it during the rental period, at an extra charge. No replacements are provided. It is strictly forbidden to use the beds without sheets/protection, in case of non-compliance, an additional cleaning fee will be applied (30.00€ per bed) General security.  The lessor assumes no responsibility for theft and/or damage of any kind (except in the event of proven negligence on the part of the lessor and by compulsory police report) throughout the site, accommodation, function room and parking lot. Smoking is strictly forbidden in all Domaine les Vallons buildings (accommodation and function rooms), except in the open air or in areas expressly designated for this purpose.Please note that pyrotechnic effects are strictly forbidden on the premises, and subject to acceptance outside.Only pyrotechnic effects authorized by Belgian law and the municipal by-laws of the town of Malmedy are permitted outdoors.)

5.  Deposit           

6.    Payment & Deposit

All information and prices given are based on our current rates (in €).The costs of the stay (tourist taxes, rental charges, rental-related charges and service charges) are payable on the day of departure when the accommodation is vacated. A rental guarantee of a minimum of €100.00 per accommodation rented will be required by bank transfer before arrival (to the FORTIS account Code BIC: GEBABEBB / IBAN BE 54 2480 0847 4897). This guarantee can be used to settle additional costs, but also in the event of deterioration of the property, loss or breakage requiring repair or replacement of the objects present. The lessor (Les Vallons) must provide a pre-rental inventory of fixtures at the request of the tenant, as well as a detailed inventory of the furniture and products placed in the accommodation. For stays of more than 8 days, SA Heindrichs Schauss/Les Vallons reserves the right to demand advance payment of costs (partial or total). Failure by the customer to pay the amount demanded (in writing, dated) within 24 hours will be considered as serious misconduct which entitles the rental company to immediately terminate the contract without prejudice to claiming damages from the customer if applicable.. For billing purposes, the customer is considered to be the natural or legal person to whom the booking confirmation has been sent.

 Invoices sent by post and/or electronic version (email) to the customer are payable on receipt. Any discounts granted for group bookings apply to a minimum of 3 accommodations. If this minimum number is not reached, SA Heindrichs Schauss /Les Vallons reserves the right to modify its rates accordingly. Invoices for "extras" relating to a group holiday are payable before the group's departure, unless otherwise instructed in writing by the company responsible for the booking. In the case of payment by voucher, the balance due will be paid on receipt of our invoice. In the event of late payment, a fixed and irreducible indemnity equal to 15%, with a minimum of €50, and interest at the rate of 10% per annum from the date of invoice, will be charged automatically and without formal notice.

7.    Customer's duty & taxes. 

The nominative list of participants must reach the hotel at least 15 days before the date of arrival. A tourist tax is required by the local authorities (Ville de Malmedy). This tax is applicable per night, per person. 

8.Events & Parties.

SA Heindrichs Schauss does not permit the organization of special Events on its premises and in its lodgings without its written consent. The hirer is the "exclusive organizer" of his event, with all rights and obligations arising therefrom.  In this respect, the hirer assumes all risks whatsoever resulting or likely to result from the organization, preparation and running of the event. The hirer is obliged to comply with the law in force (compliance with noise limits and hours of noise nuisance stipulated by Belgian law). Any additional services are provided by the lessor in accordance to the lessee's requirements, in agreement with the lessor and at the lessee's expense. These services must be specifically stated to the lessor. The lessee is not authorized to use external companies without prior written agreement from Les Vallons.

9. Assignment and sublease, multiple tenants

The lessee may not assign the rights under this rental agreement to a third party without the written consent of the lessor (Heindrichs-Schauss AG). In the event of an accepted sublease, the lessee shall bear all liability, jointly and severally with the sublessee. If there is more than one lessee, all are jointly and severally liable to the lessor.

10.  Termination of the rental agreement.

Les Vallons (SA Heindrichs Schauss) may terminate the booking at any time and without notice if:

• The contractually required deposit payments and guarantees are not fulfilled and justified in writing.
• The hirer fails to comply with any of his contractual obligations or any of the provisions of these general terms and conditions.
• The lessee is declared bankrupt or is in (partial or full) receivership. 
•  An event with the characteristics of force majeure occurs, making it impossible for the lessor to make the premises available.

If the lessor terminates the contract without notice for one of the above-mentioned reasons, the lessee's obligation to pay the rent is not extinguished, except in the case of force majeure. Termination for one of the aforementioned reasons does not entitle the lessee to claim damages from the lessor.

11. Legal and jurisdictional competence

The company located in B-4960 Malmedy, route d'Eupen 54, reserves the right to modify its prices and general conditions (excluding defined rental prices / ancillary products and services). All our prices are in € (EUR). In the event of a dispute, and failing amicable settlement, Belgian law will apply before the courts of Belgium, Province of Liège, Verviers division, which will have sole jurisdiction.
