It is wise to read these terms and conditions carefully before making a reservation. Here you will find the rights and obligations of you and Berghaus Wanderlust. 1. Reservations 1.1 These General Terms and Conditions of Reservation apply to all our reservations. Exceptions are only possible in incidental cases and if confirmed in writing by Berghaus Wanderlust. 1.2 The client is jointly and severally liable for the fulfillment of all obligations by themselves and all fellow travelers arising from the reservation confirmation. 1.3 We only accept reservation requests from persons aged eighteen (18) or older. Reservations made by persons younger than that age are therefore not valid. 2.Reservation order and payment 2.1 Every reservation request will be confirmed by Berghaus Wanderlust by means of a reservation confirmation sent by email or post. 2.2 The deposit (hereinafter collectively referred to as "the rental price") must be paid within two weeks of receiving the reservation confirmation. The remaining rental price must be paid no later than 10 weeks before the arrival date. For reservations made less than 10 weeks before the arrival date, the full rental price must be paid in one lump sum. 2.3 In the event of late payment, Berghaus Wanderlust is entitled to cancel the reserved accommodation. The cancellation conditions will then remain in full force (see Article 3). 3. Cancellation by the tenant 3.1 Cancellations must be communicated to Berghaus Wanderlust by telephone or email. Upon receipt of the cancellation, Berghaus Wanderlust will send you a cancellation confirmation/invoice within seven days. 3.2 In case of cancellation, the refund percentages listed below apply. Berghaus Wanderlust advises you to take out cancellation insurance.
4. Cancellation by Berghaus Wanderlust If, with the exception of the situation described in paragraph 7.8., Berghaus Wanderlust is forced to cancel the reserved accommodation, the tenant in question will be informed immediately and, if possible, offered an alternative. If the tenant does not accept this alternative, or if Berghaus Wanderlust is unable to offer an alternative, Berghaus Wanderlust will immediately refund the amount already paid by the tenant. The tenant has no other rights than to reclaim this amount. 5. Changes made by the tenant If the tenant wishes to change Book Now another apartment Book Now or wishes to change the rental period, this is always possible up to 5 months before the start of the rental period of the reserved accommodation (subject to availability). The associated costs are €100.00. If no apartment is available during the desired period, the conditions for cancellation by the tenant as stated in Article 3 apply. If the desired rental period is shorter than the period already reserved, Article 3 for cancellation by the tenant applies in full to the difference in rental days. 6. Liability of the tenant 6.1 During their stay in the accommodation, the tenant is fully liable for the rented accommodation, the furnishings, and all items belonging to the rented property. Any damage caused by the users of the accommodation or elsewhere in Berghaus Wanderlust must be compensated in full by the tenant to the landlord immediately. Berghaus Wanderlust is entitled to hold the tenant liable if the damage caused has not been settled, or has not been settled properly, or if the costs to be paid on site have not been paid (in full) by the tenant. All associated (collection) costs will be borne in full by the tenant named in the reservation confirmation. For damage and/or defects that are not reported to the management of Berghaus Wanderlust by the day of arrival at the latest, the aforementioned liability of the tenant applies. 6.2 The number of persons stated in the booking confirmation is the maximum number permitted. Occupancy by more persons is not permitted, and Berghaus Wanderlust is entitled to refuse access to the accommodation if occupancy by more than the permitted number of persons occurs. 7. Liability of Berghaus Wanderlust 7.1 Berghaus Wanderlust accepts no liability for loss, theft, damage, or personal injury of any kind. 7.2 Obvious errors or mistakes in the description or prices of the accommodations offered by Berghaus Wanderlust are not binding on Berghaus Wanderlust. Berghaus Wanderlust cannot accept any liability for interim changes to data, prices, or printing errors. 7.3 The (price) information in the most recent price list and on the website is authoritative. Therefore, the (price) information from previously published editions is no longer valid. 7.4 Berghaus Wanderlust cannot accept liability for damage caused by natural forces, natural disasters, nuclear disasters, attacks, strikes, acts of violence, or contact with an aircraft or parts thereof. 7.5 Not all facilities mentioned in the description are open every day, all year round. Berghaus Wanderlust is not liable for facilities that were unavailable during your vacation for any reason. Use of all facilities is at your own risk. Facilities may be unavailable or temporarily out of service due to circumstances. You cannot claim any refund from Berghaus Wanderlust for this. 7.6 Construction work may be carried out in the vicinity of the rented accommodation. Berghaus Wanderlust accepts no responsibility for any noise nuisance or other inconvenience. 7.7 All our reservation agreements and any subsequent agreements are governed by Austrian law. Any disputes arising in connection with an agreement will be settled by the competent court. 7.8 No refund of the travel sum will be made in the event of "force majeure," including, but not limited to, a damaging event such as a natural disaster, attack, epidemic, act of war, or danger threatening you during the trip. This also applies if the infrastructure has been affected to such an extent that the trip cannot reasonably be made. 8. WiFi/W-Lan Due to Berghaus Wanderlust's location in the mountains, WiFi speed, strength, and range may be limited and therefore cannot be guaranteed. 9. Accommodation tax The accommodation tax (also known as tourist tax) is based on a legal regulation and serves to promote tourism. The landlord is obliged to collect the accommodation tax. The tourist tax is €2.70 per person, per night (from 17 years of age) until April 2026. From May 1, 2026, the tourist tax is expected to increase to €3.60 per person, per night (from 17 years of age). Should this amount change, it will be settled on the final bill. |
